What is a certificate of no criminal record in Georgia?
A certificate of no criminal record (no criminal record) is an official document issued by the Ministry of Internal Affairs of Georgia (MIA), which confirms that a person has not been convicted of any act that violates the law on the territory of Georgia. The certificate is issued by separate departments of the MIA, which are called Service Agencies. The papers are issued in Georgian. They are valid for half a month (15 calendar days) from the date of issue. It is important to take this validity period into account when planning to contact other authorities.
Why might you need a certificate of no criminal record?
A certificate of no criminal record is requested in many situations related to international procedures, employment and other legal issues. Here are some of them:
- Immigration. Obtaining a residence permit, permanent residence or citizenship in other countries. Many countries require a certificate of no criminal record as proof of your reliability.
- Employment. When applying for a job, especially in government agencies, educational institutions, organizations working with children (for example, schools, kindergartens), as well as companies related to finance or security, a certificate of no criminal record is a mandatory document.
- Visa processing. Some countries request such papers when applying for an entry permit. This is especially relevant for long-term visas or permits intended for work or study.
- Participation in tenders. When participating in international tenders, a certificate of no criminal record may be necessary to confirm your reputation and reliability.
- Legal procedures. Various authorities may request citizenship status in certain legal procedures: adoption, guardianship, divorce proceedings involving foreign citizens, etc.
How to get a certificate
To obtain the necessary papers, a citizen will have to interact with the country’s Ministry of Internal Affairs department one way or another. This can be done in person or through a trusted person (legal consultations). You can send a request through the organization’s website. An independent application usually takes more time, and for foreign citizens it is difficult due to the language barrier and ignorance of legal subtleties.
Required documents:
- Identity card (passport, ID card);
- Copy of passport (all pages with marks);
- Confirmation of payment of state duty (receipt);
- Application (submitted to the Agency);
- Consent to the processing of personal data.
Obtaining procedure:
- In person: you provide originals and copies of documents, pay for the service, fill out an application on the spot.
- Online: you upload scans or photographs of the required documents, pay for the service online, fill out an electronic application form.
- Through a representative: your representative must present a notarized power of attorney, as well as all the necessary papers.
- Issuance time: depends on the request. Urgent consideration will require an additional fee. On average, consideration takes three business days. An urgent request will be considered within one day.
Apostille and legalization
If the document is needed for use abroad, an apostille or consular legalization may be required.
- Apostille. For countries participating in the Hague Convention. The agreement simplified the method of confirming the official status of foreign personal and business papers. An apostille is a special stamp that is placed on official documents and confirms their authenticity.
- Consular legalization. The legalization procedure usually includes certification of the document by the Ministry of Justice, the Ministry of Foreign Affairs, and the embassy of the destination country.
