An official divorce by mutual consent in Georgia is processed through the Public Service Development Agency (House of Justice). Although the procedure is regulated, foreign nationals often encounter difficulties completing applications in Georgian and navigating the administrative steps.
Georgia Assistant helps spouses complete the procedure comfortably, prepare their documents correctly, and formally dissolve their marriage without legal errors. With us, divorce through the Georgian justice authorities becomes a straightforward administrative process.
Administrative vs. Court Divorce: What's the Difference?
The main differences between the two ways of obtaining a divorce in Georgia concern where the case is handled, the requirements for the spouses’ personal attendance, and whether there are disputes between them.
Criterion | Administrative divorce (through the House of Justice) | Court divorce (through the courts) |
Where the procedure takes place | At House of Justice branches (Public Service Development Agency) | In a Georgian district or city court at the place of registration or residence |
Mandatory condition | Mutual consent of the spouses, with no disputes over property or minor children | Disputes about division of property, children’s residence, child support, or the refusal or nonappearance of one spouse |
Personal attendance | Mandatory. Both spouses must appear in person at the House of Justice twice: when applying and when collecting the certificate 10 days later | Not mandatory. The proceedings may be handled by a lawyer appointed under a notarized power of attorney |
Where the marriage must have been registered | In Georgia only. The House of Justice dissolves only marriages registered in Georgia | In any country. Georgian courts can divorce foreign nationals even if their marriage was registered abroad |
Official timeframe | A fixed period of 10 days (7 working days for the authority) | From 2–6 months or longer, depending on the complexity of the case, the court’s workload, and whether the parties or their representatives attend hearings |
How to Get Divorced in Georgia Without Going to Court
It is important to distinguish between the different divorce procedures in Georgia. One of the simplest is divorce through the House of Justice. This option is suitable for couples who have made a joint decision and are ready to complete the necessary steps amicably.
Most importantly, the House of Justice can dissolve only a marriage that was previously registered in Georgia. If the marriage was registered at a civil registry office or by the authorities of another country, it cannot be dissolved in Georgia through this administrative process.
In addition, an administrative divorce requires full mutual consent. The spouses must have no unresolved disputes over the division of jointly acquired property or the residence of their minor children. Any such conflict means the divorce must be handled through the courts.
Having children does not in itself prevent a divorce. Under Georgian law, if the spouses have no disputes, they can dissolve their marriage without court proceedings even if they have minor children.
Divorce in Georgia: Step by Step
The standard 10-day divorce process includes the time required to prepare and legalize documents and the period prescribed by the Georgian authorities. To avoid delays, it is divided into three stages:
- Stage 1. Document preparation and notarized translation.
Before contacting the government authorities, both spouses’ international passports are officially translated into Georgian. The translator’s signature must also be certified. The original Georgian marriage certificate is checked against the electronic records of the Georgian Public Service Development Agency. - Stage 2. Filing a joint application at the House of Justice.
The spouses visit a House of Justice branch in Tbilisi in person and submit a joint application. The official forms must be completed correctly in Georgian, which is why couples often seek legal assistance. A consultant also helps pay the government fee at the cashier and submits the documents to the registrar. Once the application has been registered, the statutory review period begins. It lasts five business days (up to ten calendar days including weekends). - Stage 3. Second visit and issuance of the divorce certificate.
Once the statutory review period has ended, both spouses must return to the authority. The House of Justice issues an official stamped paper divorce certificate. Both spouses are often required to attend in person at this final stage.
What Documents Are Required?
To initiate an administrative divorce at the House of Justice, a married couple must submit the following original documents:
- Identity documents (international passports for foreign nationals). Valid originals are required.
- Marriage certificate. The original certificate issued by the Georgian authorities.
- Notarized translations. Official Georgian translations of the main pages of the spouses’ international passports, certified by an authorized notary.
- Proof of payment of the government fee. A receipt confirming payment of the mandatory service fee.

Frequently Asked Questions About Divorce in Georgia
No, not through the administrative procedure. The House of Justice dissolves only marriages that were registered in Georgia. If the marriage took place abroad, divorce is possible only through the courts.
An administrative divorce takes around six weeks, including a mandatory one-month reconciliation period. If the application is filed and confirmed after five business days, the process may be quicker and take only ten days. A court divorce takes three to six months on average.
The government fee for an administrative divorce is approximately лари 45–60. A court divorce involves a higher fee depending on the claims made. Legal assistance costs around USD 150.
In that case, the marriage can be dissolved only through the courts, which may order a reconciliation period of up to six months. If reconciliation fails, the marriage will be dissolved. Georgian law does not require proof of fault; it is sufficient to establish that the marital relationship has irretrievably broken down.
